1. Acceptance of Terms

By accessing and using Casso Sites ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Casso Sites provides an AI-powered website building platform that allows users to create, edit, and publish websites. The Service operates on a credit-based system where users purchase credits to access various features including website generation, page creation, and AI-powered editing.

3. Credits and Domain Slots

Credit System: Users purchase credits to use various features of the Service. While credits do not expire under normal circumstances, the Company reserves the right to revoke credits at any time at its sole discretion.

Domain Slots: Domain slots allow users to connect custom domains to their websites. The Company reserves the right to revoke domain slots at any time at its sole discretion.

No Refunds: All credit and domain slot purchases are final and non-refundable.

4. Service Availability and Company Cessation

Service Continuity: While the Company strives to maintain continuous service, we do not guarantee uninterrupted access to the Service.

Company Cessation: In the event that the Company ceases to operate, the Company is NOT liable for the continued upkeep, hosting, or availability of websites built using the Service. Users are solely responsible for backing up their website content and making alternative hosting arrangements.

No Liability: The Company shall not be held liable for any loss of data, business interruption, or any damages resulting from service discontinuation.

5. User Content and Responsibility

You are solely responsible for the content you create, upload, and publish using the Service. You agree not to use the Service to create or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

The Company reserves the right to remove any content that violates these terms or is deemed inappropriate at the Company's sole discretion.

6. Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify the Company immediately of any unauthorized use of your account. The Company is not liable for any loss or damage arising from your failure to protect your account information.

7. Intellectual Property

The Service, including all software, designs, text, graphics, and other content (excluding user-generated content), is owned by the Company and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the content you create using the Service. By using the Service, you grant the Company a license to host, store, and display your content as necessary to provide the Service.

By creating an account, you may opt-in to receive occasional marketing and promotional emails from Casso Sites. You can unsubscribe from these communications at any time by following the unsubscribe link in any marketing email or by updating your account preferences.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

THE COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE COMPANY IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Termination

The Company may terminate or suspend your account and access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

The Company reserves the right to modify these Terms of Service at any time. We will notify users of material changes by posting the updated terms on the Service. Your continued use of the Service after such changes constitutes acceptance of the new terms.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company operates, without regard to its conflict of law provisions.

14. Referral Program

Program Overview: Casso Sites offers a referral program where users can earn commission by referring new users to the Service.

Commission: Referrers earn a 30% commission on all purchases made by referred users. Commission is calculated based on actual payments received through Stripe and tracked in the referrer's account as pending earnings.

Payout Terms: Payouts can be requested once pending earnings reach a minimum threshold of $50. Payouts are processed manually and may take 7-14 business days to complete. Payment can be made via check (mailed) or Bitcoin at the user's choice.

Program Rules: Users may not refer themselves or create multiple accounts to abuse the referral program. Fraudulent activity, spam, or other abuse will result in immediate account suspension and forfeiture of all pending earnings.

Program Termination: The Company reserves the right to terminate the referral program at any time, with or without notice, and with or without paying out pending balances. The Company may, at its sole discretion, choose to pay out some or all pending balances upon program termination, but is under no obligation to do so.

No Guarantees: Participation in the referral program does not guarantee payment of pending earnings. The Company reserves the right to withhold payment for any reason, including but not limited to suspected fraud, violation of these terms, or discontinuation of the program.
